As I understand it, which isn't very well(!), the Commission needs 9 months to scrutinise the plans. So to get derogation before 1st Jan 2010 would need the completed application filed by 31st March ? And Defra has to consult on the plans before that ? (The DfT did reveal a very shallow health impact study that indicated that the health disbenefits would be negligible!). I wonder whether the Environmet C'tee may be looking at this at its meeting on 4th February when I see that Air Quality is on the agend ?
